Terms of Service — My Coaching Voice

1. Acceptance of Terms

By creating an account or using My Coaching Voice ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

My Coaching Voice is a subscription tool that helps certified health and fitness coaches generate branded content — including client emails, lead nurture emails, promotional emails, social/SMS content, daily graphics, and lead magnet guides — based on each coach's own voice, brand, and monthly content themes.

3. Eligibility and Accounts

You must be at least 18 years old and operating a legitimate coaching business to use the Service.

Each subscription is for one coach/business. Accounts may not be shared across multiple coaches or businesses.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Subscription and Payment

The Service is billed on a recurring monthly subscription basis through our payment processor (Stripe).

Launch-window pricing, where offered, is locked at the rate in effect when you subscribe, for as long as your subscription remains active and uninterrupted. If you cancel and subscribe again later, the rate then in effect applies.

Subscriptions renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and no partial refunds are issued for unused time.

We may change standard pricing for future billing periods with reasonable notice.

5. Ownership of Content

Your content. You own the content generated for your business through the Service (emails, graphics, guides, and similar outputs), subject to the underlying rights of any third-party tools used to produce it (see Section 8).

Our platform. My Coaching Voice retains all rights to the underlying software, source code, system design, prompt engineering, content generation logic, theme library, templates, and the My Coaching Voice name and branding. Nothing in these Terms transfers ownership of the platform itself to you.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, scrape, or otherwise attempt to extract the Service's underlying code, prompts, system instructions, or content generation logic.
• Share, sell, sublicense, or otherwise provide access to your account or the Service to any other coach, business, or third party.
• Use the Service to build, train, or inform a competing product or service.
• Use automated tools to access the Service outside of its intended interface.
• Use the Service for any unlawful purpose or in violation of your own professional certification requirements.

Violation of this section may result in immediate suspension or termination of your account without refund.

7. AI-Generated Content

Content produced through the Service is generated with the assistance of third-party AI tools. It is provided as a starting point and draft, not as guaranteed-accurate, guaranteed-original, or professionally reviewed content.

You are solely responsible for reviewing, editing, and approving any content before sending it to your clients, leads, or the public, and for ensuring it complies with any professional, certification, or regulatory obligations that apply to your coaching practice.

Content generated through the Service is not medical, nutritional, or health advice, and the Service does not diagnose, treat, or provide guidance on any medical condition. You remain responsible for staying within the scope of your own certification and for any disclaimers your content requires.

8. Third-Party Services

The Service relies on third-party providers, including but not limited to Anthropic (Claude API), Supabase, Stripe, and htmlcsstoimage.com, to operate. Your use of the Service is also subject to the applicable terms of those providers where relevant, and we are not responsible for outages or issues originating from third-party providers.

9. Data and Privacy

Information you provide (including your voice/brand profile, uploaded photos, and generated content) is used to operate the Service and is handled as described in our Privacy Policy.

10. Termination

We may suspend or terminate your access to the Service for violation of these Terms, non-payment, or misuse. You may cancel your account at any time through your account settings.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or that generated content will meet any particular standard of quality or accuracy.

12. Limitation of Liability

To the maximum extent permitted by law, My Coaching Voice and its operator are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including damages related to content generated through the Service.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
